Description:
We would like to find someone who has 5 years' experience with Medical Malpractice claims and litigation. Must have experience with commercial insurance.
Provides risk management services across organizational entities. Evaluates the risk of financial or property losses and arranges appropriate insurance coverage. Oversees the claims process, including managing activities, documentation, and files related to handling and resolving claims, ensuring each claim is addressed promptly, appropriately, and in accordance with company policy. Manages day-to-day claims operations and provides oversight and direction of all litigation and claims activities. Assumes the duties and responsibilities of the Risk Manager in their absence.
Essential Functions
- Responds to questions related to risk management and claims as they arise. Conducts and participates in Root Cause Analyses and risk assessments (e.g., PRAs, FMEAs) as needed.
- Participates in accreditation and risk management on-call rotation.
- Reviews event reports daily. Assists patient safety leadership with investigations and regulatory reporting decisions as requested.
- Conducts educational sessions on risk-related topics for various departments or entities.
- Investigates allegations of inappropriate treatment or care resulting in injury (or alleged injury) to a patient or visitor and determines appropriate next steps.
- Enhances claims processes and investigations to reduce litigation costs by tracking, reviewing, and analyzing newly litigated cases. Determines complexity and value of claims for potential resolution and attends trials as needed. Reviews initial case assessments and legal strategies and assists in developing litigation strategies.
- Collaborates with leadership to develop reporting metrics and communicates updates on current and potential litigation trends, including pre-trial reminders, daily trial updates, indemnity reserve increases, and other critical case developments.
- Identifies, gathers, and preserves discovery materials requested by defense counsel related to existing or potential litigation.
- Manages outside counsel regarding litigation, discovery matters, costs, negotiations, and settlement agreements, including identifying and assigning counsel for claims.
- Reviews and approves outside counsel invoices to ensure appropriate billing and follows up on discrepancies.
- Directs preparation and maintenance of departmental reports and prepares periodic reports for senior leadership as required.
- Provides management services to an affiliated Risk Retention Group and coordinates activities of the governing board, attorneys, and consultants.
